Rules of the Photo challenge Typical Brunssum

When you enter the ‘Photo challenge Typical Brunssum’ (hereafter: ‘Photo contest’) you agree to these conditions (hereafter: ‘Rules’) and you accept their applicability.

Therefore, it is important you read this carefully. The photo contest is offered and organized by the municipality of Brunssum (Lindeplein 1 6444 AX Brunssum), hereafter named Organizer. When you enter, you are a Participant. The Participant can hereafter be mentioned as ‘you’. The municipality of Brunssum complies with these rules and the Code of Conduct for Promotional Games of Chance.

Although the photo contest is promoted on social media, the platform in question is in no way responsible for the contest. The platform is released from any liability. In addition to this, the municipality of Brunssum explicitly confirms that the platform does not sponsor or approve the contest, nor that the platform manages or should be associated with the contest in whatever way.

Duration of the contest

The photo contest runs from 1 June 2024 12:00 until 1 August 2024 23:59. 

Guidelines for the photo:

  • The photo must represent a typical location in Brunssum or a typical moment of Brunssum;
  • The photo may in no way contain offensive, provocative, libellous, sexually suggestive or other onerous or inappropriate content;
  • People in the photograph must have given their permission for this;
  • No children under the age of 18 are allowed in the picture; 
  • The person submitting the photo, must also be the photographer of the photo;
  • No names or copyright may be visible in the picture.

Enter

  • Organizer reserves the right to exclude participants from entering when organizer is of the opinion that the participant does not comply with the rules, or has gained access to the contest in a fraudulent way. This also applies to cases when participants have tried to influence the outcome of the photo contest in an unfair way;
  • By entering the photo contest the participant agrees with the contents of the rules. 

How is the winner selected?

  • Assessing all the photos submitted will be done by an expert panel of enthusiastic people of Brunssum and a public jury, in which both juries have a 50% stake in selecting the winners;
  • Members of the expert panel can award 12 points, 10 points, 8 points, 7 points, 6 points, 5 points, 4 points, 3 points, 2 points and 1 point to their ten favourite photos. Each member has a total of 58 points to award, bringing the total number of points of the five members together to 290 points. The public jury works in a similar way, but times 5, since the expert panel consists of 5 members (12 points * 5 = 60 points).  The five photos with the most points overall will win and will be published as postcards. In case of a draw, the step below will be deleted (e.g. 40 points) and the step above (e.g. 50 points) will apply to arrive at 5 winning photographs;
  • Team Citybranding and the Editor Social Media will ensure a fair voting process.

Your personal data and permissions

  • Participants declare that personal data (name, telephone number and email address) may be used for the purpose and within the context of the photo contest and other purposes as described in these rules;
  • The moment people are recognizable in a picture, these people must have given their permission to be photographed;
  • By submitting your photo you grant permission to the municipality of Brunssum to use it for a postcard and all rights of the photo submitted go to the municipality of Brunssum, even when your picture is not chosen as the winning picture;
  • The moment you enter a winning photo and this picture contains an element not owned by you, or that is subject to rights by third parties, and/or it has people in it, the participant is responsible for obtaining and providing a written declaration of consent to publish the photo;
  • Participant is at all times free to also use the photo material himself or herself;
    When entering the photo contest you agree to our privacy conditions. These can be found https://www.onsbrunssum.nl/onsbrunssum/Privacy;
  • Organizer is responsible for processing the personal data provided by Participants in the context of entering the photo contest, and in doing so acts in accordance with the General Data Protection Regulation of the European Union nr. 679/2016 (hereafter ‘GDPR’). The data consist of first name, family name, phone number and email address. The data are processed electronically and are adequately protected by security measures;
  • Data processing by Organizer for Contractual as well as Legal Purposes is necessary. If Participant objects to this, prior to or during participation in the competition, this may result is exclusion of Participant from the competition;
  • The data collected by Organizer will be retained until one (1) year after the end of the photo contest. Upon expiry of the retention period the data of Participant will be deleted, anonymized or aggregated;
  • By entering the photo contest Participant declares to be aware of the processing of data as mentioned in these conditions and agrees to the privacy policy of OnsBrunssum as published on www.onsbrunssum.nl.

Liability

  • The municipality of Brunssum is not liable for any mistakes in the procedure and/or damage you incur by entering this photo contest, using our website or downloading any components that relate to this photo contest. In addition, neither can the municipality of Brunssum be held liable for any technical malfunctions, failures or latencies in relation to your participation or the selection of the Winners;
  • The municipality of Brunssum cannot be held liable for any form of direct or indirect damage ensuing from participation in the photo contest, including but not limited to damage suffered by third parties. This therefore includes situations when – in hindsight – it turns out that the condition of consent requirement for a photo representing someone else than the participant, has not been met.

Applicable law

  • No rights can be derived from these rules;
    The municipality of Brunssum can always make changes to the rules, or end the photo contest prematurely. If this is the case, you can check this on www.onsbrunssum.nl/fotowedstrijd;
  • In a situation where these rules are not sufficient, the municipality of Brunssum decides how the situation will be resolved;
  • This photo contest is governed by Dutch law.
